So you want to file an ANOI?
In order to file an ANOI, the following must apply to your project:
- It lies entirely in the buffer zone, Land Subject to Flooding, or the Riverfront Area.
- Less than 1,000 sqft of these resource areas would be disturbed. However, in the Riverfront Area the ANOI can only be used for small, grandfathered residential lots (310 CMR 10.58(4)(c)(2)(a)).
- Neither an Army Corps of Engineers permit nor a DEP Waterways license under G.L. Chapter 91 is needed.
